A Title IX Birthday “Bash” Indeed: The U.S. Department of Education's “Review” of Title IX Enforcement |
For those who have contributed to the national dialogue regarding Title IX and its application to athletic departments, the 30th anniversary year marking its passage has been anything but celebratory given the U.S. Department of Education’s review of enforcement through its Commission on Opportunities in Athletics. Rather than a celebration, the appointment of the Commission and its subsequent conduct has led to a revisitation of issues that were believed to be settled as a matter of law and now practice. Those who support the legislation and have worked for it to be enforced over this thirty year span of time have been called upon once again to defend its importance. In turn, serious attempts have been waged during this review to undermine the enforcement guidelines and standards in such a way that the gains of recent years may be neutralized or even reversed. This panel will address the current discussion surrounding Title IX by focusing on these three broad areas: forces that led to the appointment of the Commission, the tone and tenor of the Commission’s hearings and deliberations, and the recommendations made by the Commission. Panelists will conclude with insights as to how to proceed in light of this evolving dialogue. In order to achieve the goals for this panel, we would like to provide a critique and analysis of the current situation but provide ample opportunity for the audience to be engaged in the discussion as well. |
